Parents or legal guardians of the high school senior must attend all communications and events. They’re encouraged to come with their child but it's not mandatory.

If a Client wants to reschedule a portrait session, the Photographer can apply the initial payment if notified at least seven (3) days in advance. The new session must occur within three (3) months. Late arrivals will reduce the session time, and no refunds will be issued for this loss. If weather is unsuitable, the session will be rescheduled at the Photographer’s discretion, with fees transferred to the new date.

If the Client requests to alter or cancel their scheduled event seven (3) or more calendar days prior to the confirmed photographic event date, the initial non-refundable payment will be graciously applied to a mutually agreed upon reschedule date that works for both parties. However, if the Client fails to show up for the event or decides to cancel within seven (3) or fewer calendar days before the agreed upon photographic event date, the initial non-refundable payment will unfortunately be forfeited, as we won’t be able to accommodate last-minute changes.

The Photographer isn’t responsible for anyone’s behavior during the shoot, except their own team. If the session doesn't go as planned because of others, the Photographer isn't liable. The Client must help the Photographer secure the right photos by naming people or scenes to capture, posing as directed, and guiding the Photographer to the right locations. If the Client doesn't cooperate, the Photographer can’t be held responsible for missed photos.

The client understands that Beatriz Garcia Fine Art LLC decides how to provide services, including poses, lighting, and lenses. The client knows the photographer’s work and requests services aware that their style is unique, artistic, and always changing, so the new images may look different from previous ones.

Beatriz Garcia Fine Art LLC can use any photos they take for their portfolio and promotions. If a client wants their images kept private, they agree to pay an extra privacy fee, decided by BGP, along with the sitting fee. Once this fee is paid, BGP will not use the client's images publicly, including on their website or in ads.

BGP gives you a non-exclusive, non-transferable, lifetime personal-use license to download and copy the purchased digital images from the online gallery ("Media").
WHAT YOU CAN DO:
Share images on your personal social media and devices.
Print images for personal use. Note that colors may vary based on your computer settings, and BGP isn't responsible for any color differences.
WHAT YOU CANNOT DO:
Edit images in any way, including cropping or using filters from platforms like Instagram or Facebook. This restriction applies to everyone.
Sell, share, or redistribute the images without written permission from BGP.
Use the images for profit, charge fees, or receive any payment without written permission from BGP.
Use the images in advertising without written permission from BGP.
Use the images in any inappropriate, illegal, or harmful manner.
Include images in logos or trademarks without written permission from BGP.

BGP manages all photo selection and editing. After the portrait session, the photographer carefully chooses images that meet high quality standards. Photos with closed eyes, bad poses, or duplicates are discarded. BGP does not guarantee a specific number of final images. RAW files will not be released under any circumstances. The chosen images will be color-corrected and lightly edited. BGP decides which images are shown in color or black and white. During retouching for prints, temporary marks like acne or bruises will be edited out. Any extra edits requested by clients, like removing scars or reshaping bodies, may incur additional fees at the photographer’s discretion.

BGP takes care in capturing, processing, and delivering images. If the photographer fails to meet its contract obligations for any reason, including factors beyond its control or negligence, it will only refund what the client has paid. For partial loss of original images, the refund will be a percentage based on the total number of lost images.

The client agrees to protect BGP and its staff from any losses, damages, or claims caused by the client's actions or those of their guests or vendors. If a claim arises, the client will pay for BGP's defense costs using a lawyer acceptable to BGP. This agreement remains effective even after the client session ends.

By signing any digital or physical form or portrait contract with BGP, the client gives unlimited permission to BGP to use, reproduce, and share their images and/or property anywhere, anytime, and for any reason. This includes commercial use, advertising, marketing, and more. The client understands that their images may be changed or combined with other elements and may not look the same. They will not be able to review or approve how the images are used. The client agrees they will not receive any payment for the use of their images and will not make any claims against BGP for compensation.

If the client selects a location that has fees or needs permits, they must pay all related costs, including entrance and parking fees. The client also has to arrange access and obtain any needed permits. BGP must follow the site's guidelines, and the client is in charge of discussing any changes to the location's rules.
